The Website User and Membership Terms and Conditions govern your use and access to and/or membership in, www.Gamingserver.eu. Hereinafter,  Gamingserver.eu may be referred to as “GS”. These Terms and Conditions apply to you whether you are a paid member who leases server space from us, a player who contributes to the membership fees of one of our members, a passive or active user of our services, or if you are merely browsing our site.

GS is providing leased gaming server space and other associated internet-based gaming/hosting services. These services may be referred to in this agreement as “our/ the Services”.

These Terms and Conditions apply to visitors and members of GS. By accessing, using, viewing, reading, printing, installing, or downloading any material from us, or becoming a member of GS, you agree to be bound by these Terms and Conditions.

We reserve the right to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. The user should periodically check this web page for any modifications regarding these Terms and Conditions by re-visiting this web page. The date of the last update will always be on top of the page.

If you do not agree to be bound by these Terms and Conditions, you may not use our site, servers, or any other services: you must exit the GS site immediately and may not use or access the website. You may use and access our services only in accordance with these Terms and Conditions and any applicable laws. You confirm that you have read this Agreement and understand, agree and consent to its Terms and Conditions.

You are solely responsible for access to our services and it may involve third party fees (ISP etc), with additional costs.

You agree not to use or access our services if doing so would violate the laws of your state, province or country.

All images, text, graphics, data are copyright of GS and/or their respective copyright owners.

You warrant you are at least 18 years of age and that you have the legal capacity to enter into this Agreement. Teenagers, under the age of 18 must have the permission of a parent or legal guardian to access, use or play on the site. We do not assume any responsibility or liability for any misrepresentations regarding a user’s age.

Membership and passwords may not be assigned, transferred, or sold to a third party. GS is not responsible for any and all liability arising from fraudulent use of our services. If a user fraudulently obtains access, we may terminate membership immediately and take all necessary and appropriate actions under applicable local and international laws.

To access GS or other services, you may be asked to provide certain registration details or other information. It is a condition of your use of our services that all information you provide will be correct, current, and complete. If we believe that the information you provided is not correct, we have the right to refuse access to our services and to terminate access at any time with no refund.

Subject to these Terms and Conditions and by using our services, we hereby grant you a limited, nonexclusive, nontransferable personal license to access and use our services. We provide our services for personal, non-commercial use by all, but not limited to visitors and subscribers. Our services shall be for private non-commercial use only, and all other uses are strictly prohibited, unless approved by GS in writing. We reserve the right to limit bandwidth usage. Any unauthorized use of our services terminates this limited license effective immediately. You represent and warrant that you will not allow anyone under 18 to access our services without the permission of a parent or legal guardian. We reserve the right to terminate this license at any time if you breach or violate any provision of this Agreement and Violators of this limited license may be prosecuted to the fullest extent under the applicable laws.

You may not circumvent any encryption; exploit software errors in order to manipulate the system; decompile, reverse engineer, modify or disassemble any of the software aspect of the Services; interfere or attempt to disrupt or damage GS or our Services; or use any data mining, bots, or similar data gathering and extraction tools on our servers, or any of our services.

You may access the non-public portion including our gaming server services with the permission of a member whose server space that you access. We reserve the right to modify our services at anytime, with or without prior notice.

Members may lease server space by completing an online registration form, which must be accepted by us, and you must pay all applicable fees. Upon submission of the online registration form, we will process the application.

You must provide true, accurate, current and complete information about yourself as prompted by the registration form and update the information if necessary.

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of GS, as well as subjecting you to criminal and civil liability.

Subscription fees are refundable, and you are responsible for any credit card charge backs and any related fees that we incur with respect to your account. There is a 14 day return on the game and voice servers, all refunds will be paid in Euro (EUR). The amount will be refunded within a maximum of 14 days. There will be deducted a fee of € 3 and the pro-rata days you have used the server. There is no refund of value added products or domain names. Subscription fees are listed on our website.

Your membership, the ID and password are nontransferable and non-assignable. You represent and warrant that you will not disclose to any other person and that you will not provide access to our services to anyone who is not specifically authorized to use them.

You must immediately notify us of any unauthorized use of your user name and password or any other breach of security. You are liable and responsible for any unauthorized use of the services. Unauthorized access to GS and its services is illegal and a breach of this Agreement. You indemnify us against all activities made through your account.

Membership fees for use of GamingServer are prominently displayed prior to processing your subscription thereto. You agree to pay all membership fees when due. We reserve the right to contract with a third party to process all payments like PayPal. Such third party may impose additional terms and conditions governing payment processing. We reserve the right to make changes to our fees and billing methods, including the addition of supplemental charges for any content or services provided by us, with or without prior notice to you, at any time.

If you believe that you have been erroneously billed, please notify us immediately of such error. If we do not hear from you within thirty (30) days after such billing error first appears on any account statement, such fee will be deemed acceptable by you for all purposes, including resolution of inquiries made by your credit card issuer. You release us from all liabilities and claims of loss resulting from any error or discrepancy that is not reported to us within thirty (30) days of its publication.

You can choose to activate your membership by paying through PayPal every month or choose to use the subscription option to automatically pay every month. You will be notified to when payment should be made. If payment is not made on time, there is a grace period of 2 days after the last day for renewal of the service. The service terminates automatically if not paid within 2 days for the next period and GS erases the server and all information automatically and can’t be recovered.

You expressly agree that use of our services or any of our materials is at your own and sole risk. Our services are provided “as is” without warranty of any kind. We may change any of the information found on the site at any time without notice including the terms of service without notice.

The provision of any services which is in violation of any laws is strictly prohibited. If you or any user has provided or intends to purchase or provide any services in violation of any law, your ability to use our services will be terminated immediately. We do hereby disclaim any liability for damages that may arise from any user providing any services for any purpose that violates any law. You do hereby agree to defend, indemnify and hold us harmless from any liability including any third party that may arise should you violate any law.

In no event shall we (or any of our partners, suppliers, affiliates, members or other related parties) be liable to you, or any other third party for any direct, special, indirect, incidental, consequential, exemplary, or punitive damages, including without limitation, damages for loss of profits, loss of information, business interruption, revenue, or goodwill, which may arise from any person’s use, misuse, or inability to use our services or any of the materials contained therein, even if we have been advised of the probability of such damages. This is for any matter arising out of or relating to this agreement, whether such liability is asserted on the basis of contract, tort or otherwise, even if we have been advised of the possibility of such damages.

In no event shall our maximum total aggregate liability hereunder for direct damages exceed the total fees actually paid by you for use of our services for a period of no more than one (1) month from the accrual of the applicable cause or causes of action.

You agree to defend, indemnify, and hold harmless, GamingServer and our officers, directors, shareholders, employees, independent contractors, telecommunication providers, and agents, from and against any and all claims, actions, loss, liabilities, expenses, costs, or demands, including without limitation legal and accounting fees, for all damages directly, indirectly, and/or consequentially resulting or allegedly resulting from your, or you under another person’s authority including without limitation to governmental agencies, use, misuse, or inability to use our services or any of the materials contained therein, or your breach of any of these Terms and Conditions. We shall promptly notify you by electronic mail of any such claim or suit, and cooperate fully (at your expense) in the defense of such claim or suit. We reserve the right to participate in the defense of such claim or defense at its own expense, and choose its own legal counsel, but are not obligated to do so.

These Terms and Conditions and all matters arising out of, or otherwise relating to, these Terms and Conditions shall be governed by Danish law. Exclusive venue for any litigation or arbitration permitted under this Agreement shall be with the court located in Copenhagen, Denmark.

We reserve the right to change any of the provisions posted herein and you agree to review these Terms and Conditions each time you visit GS or you specifically waive your right to do so. Your continued use of our services following our posting of any changes to these Terms and Conditions constitutes your acceptance of such changes.
